I have been there, at your position, for a different problem.

 

It was two years ago. I wrote something boasting, exaggerating, and arrogant about my job. I stated that I was a better employee than the two other guys. Somehow, they managed to find out the status through their networking ability, printed its screenshot on a piece of paper, and showed that printed paper to my superior. They did it without even notifying me or informing me about it at all. I just knew about such problem after my superior called me personally into his room for "job assurance" issue. Once inside the room, I found out that they were there, alongside my top superior. They interrogated me with almost identical questions for several hours, and they said that the rest of the employees already knew about my writing. Then, they offered me a resign letter for me to sign.

 

I knew that even if I fought for my job, the other employees would not welcome me anymore, and probably they would create hell for me. So, I quickly signed the resign letter and went off from that office forever. At least, there was one positive thing I got from my resignation: I got myself another job which granted me more money, more experience, more relations, and less working time. I have to thank them for firing me smoothly. Since then, I have been using my facebook to talk about general things, from politics, economics, culture, and religion - not about my job or anything related to my job.

As has been said, It is all about the state laws regarding your employment. But dont give up fighting if your state law doesn't allow you to sue over wrongful termination. If you worked for a sizeable company or a company associated with a sizeable company(Franchise) chances are it's incorparated in the sate of Delaware.(You can sue the company in a state it is incorporated in has head offices in or  the state you worked  in) In Delaware you have those rights and you should be able to sue for wrongful termination. You would not countinue working their in most instances but receive damages. I would consult a lawyer before taking any legal action.
