You're right, they're not comparable: one has produced enough evidence of potential wrongdoing to result in a trial, one has not.
Sending and storing classified information in your home is a crime. Deleting the words "Classified" off the documents does not make the information unclassified. Instructing your staff to delete the classified marks off the information, and send it to your private server at your home, is a crime. No one is above the law. Soon, very soon.
